This section provides information on how to complain about dog fouling.
Last year the Council received several complaints about irresponsible dog owners who do not clean up after their animals. Regular patrols are undertaken and information from the public is extremely helpful in identifying both problem areas and 'offenders'.
For complaints about dog fouling please ring the Technical Services Department during normal office hours (01720 424025), contact the department by email (techservices@scilly.gov.uk) or contact the Dog Warden, when she is on active duty out on patrol.
Information is key to the successful conclusion of a dog fouling complaint. First and foremost details of the offender are most welcome as direct action can be taken. If this is not known, then any information about where and when the offences take place is very useful.
There is a Dogs Fouling Footways Byelaw on the Isles of Scilly which states:-
(a) No person being in charge of a dog shall allow the dog to foul the footway of any street or public place by depositing its excrement thereon. Provided that in proceedings for an offence against this byelaw it shall be a defence for the person charged to prove that he took all reasonable precaution and exercised all due diligence to avoid the commission of the offence.
(b) For the purpose of this byelaw the owner of the dog shall be deemed to be in charge thereof, unless the Court is satisfied that at the time when the dog fouled the footway it had been placed or taken into the charge of some other person.
The Dogs (Fouling of Land) Act 1996 also applies.
