Privacy Notice How we use your information

The Council of the Isles of Scilly collects and processes personal information in order to carry out consultation and engagement activities related to the preparation of the Local Plan. When you register to be notified about Local Plan consultations, we collect your contact details so that we can send you updates at appropriate stages of the plan‑making process.

We will only collect the minimum personal information necessary for these purposes.

What information we collect

We may collect the following personal information:

  • Name
  • Email address
  • Postal address (if needed for correspondence)

We may collect this information through email, online forms, written correspondence, or other consultation tools used by the Council.

Why we collect your information

Your information is collected so that we can:

  • Contact you about Local Plan consultations and related engagement activities
  • Keep you informed as the Local Plan progresses
  • Invite you, where relevant, to take part in themed discussions or topic‑based consultations

Our lawful basis for processing your personal data is the performance of a task carried out in the public interest. This task is established under the Planning and Compulsory Purchase Act 2004 and the Town and Country Planning (Local Planning) (England) Regulations 2026, which set out statutory requirements for consultation during Local Plan preparation. 

If you choose to provide your details solely to receive updates, your consent will also form part of the lawful basis for processing.

How your information will be used

Your contact details will only be used for the purpose of notifying you about Local Plan consultations and related plan‑making activities. Your information will not be used for marketing or profiling, and it will not be used for automated decision‑making. 

If you later submit formal comments on draft stages of the Local Plan, your name and representation may be published as part of the consultation record, in line with established plan‑making practice. Other personal details such as your address, email, or telephone number will be redacted and will not be published. This reflects the approach taken by other local planning authorities when publishing Local Plan consultation responses. 

Who we may share your information with

Your contact information may be shared with:

  • The Planning Inspectorate or Programme Officer, if required during the Local Plan Examination
  • Other service areas within the Council where necessary for plan‑making or statutory functions

We will not share your personal information with third parties for marketing purposes. We do not sell your information or transfer it outside the UK. 

How long we keep your information

If you have asked to be kept informed about Local Plan consultations, we will retain your contact details until the Local Plan is adopted or until you ask us to remove you from the consultation database.

If you submit a formal representation, this may, in accordance with national plan‑making requirements, become part of the public examination record and retained permanently as part of the Local Plan evidence base. 

How we protect your information

All personal information is stored securely. We use recognised security standards and controls to prevent unauthorised access, misuse, or loss of your data. Your information is treated as confidential, and staff receive guidance and training on data protection.

We will notify you promptly if there is a data breach that may affect you.

Your rights

Under data protection legislation, you have the right to:

  • Access your personal data
  • Request correction of inaccurate information
  • Request erasure of your information in certain circumstances
  • Restrict or object to how your information is processed
  • Request the transfer of your data to another organisation where applicable
  • Be informed about how your data is used
  • Complain if you believe your information has been mishandled
