For sale by sealed bid - Jerusalem Terrace

The Council is selling approximately 0.04 acres of land at Jerusalem Terrace by sealed bid. The land is surrounded by residential properties but is also close to commercial use properties, and the main retail area of Hugh Town. The small parcel of amenity land adjacent is located behind a tall granite stone boundary wall and adjacent to an electricity sub-station. It is sold with covenant for use as public walks and pleasure grounds.

How to submit a sealed bid

All bids must be sealed in an envelope and returned to the following address, with the reference clearly marked:

Deadline

Bids must be received before the deadline at 4pm on 6 February 2026 in order to be considered. Late bids will not be considered, unless agreed with the Council of the Isles of Scilly prior to the deadline.

Submitted bids are final and the Council reserves the right to reject any or all bids.

Directions and viewings

The land can be located via the What3Words app using ref ///cocoons.rare.soulful

Interested applicants may view from the roadside during reasonable daylight hours, ensuring they take care whilst doing so and should not trespass over neighbouring land in order to access the site, or cause disturbance to neighbouring occupants. Access to the site for viewing is by prior arrangement only.

Additional fees and considerations

The Council’s legal fees, administration and advertisement fees will be payable by the purchaser in addition to the bid price. These are expected to be in the region of: £2,500.

All buyers are advised to inspect all available legal documentation prior to bidding. The successful buyer/buyers will be deemed to fully understand what they may be liable for, including any Stamp Duty, Land Registry fees and VAT that may become payable on completion, in line with any property transaction. If, as a buyer, you are in any doubt, we advise you to seek advice from your own professional advisors.

Any costs incurred by a potential purchaser prior to completion are entirely at their own risk and cannot be recovered from the Council of the Isles of Scilly in the event a sale does not proceed, for any reason.

Summary of costs payable by the prospective purchaser:

  • Advertisement actual costs, including VAT, up to a maximum cost of £90
  • Council’s minimum legal costs of £2,250 plus disbursements
  • Purchaser’s own solicitors costs

Japanese Knotweed was present on the site but was eradicated several years ago by spraying/stem injection.

Planning

There is currently no active planning permission or applications present for this site. Prospective purchasers are advised to consult with the Local Planning Authority about the need for and likely prospects of obtaining planning consent for any particular future use of the land and the cost of obtaining that consent.

Any decision by the Council to sell the land is separate from any decision to grant planning consent and the prospective purchaser must not assume that planning consent will be granted automatically just because the Council ultimately decides to sell the land. The purchaser is also responsible, where applicable, for applying to remove the restrictive covenant and any associated costs (from the relevant third party) before planning can be considered.

Timescales for advertisement and completion

The land in question is an open space. In accordance with the Local Government Act 1972 s126(4), the proposed land sale will be advertised for 2 weeks prior to sale in a local newspaper (The Cornishman), as well as on the Council’s website and social media.

The anticipated timescale for completion of the sale is 3 months. However, this will depend on various factors, including the prospective buyer’s financial chain and legal due diligence.

Proceeds from the disposal of fixed assets are capital receipts and are subject to statutory controls. In accordance with Local Government Act 2003 c. 26 Part 1 Chapter 1 Capital Receipts, such proceeds can only be used for capital purposes and not revenue purposes – these include the purchase of fixed assets, the significant enhancement of fixed assets, the making of capital grants, or the repayment of long-term loans.
